The Derby betting guide: Recital to spoil The Queen's House party

Kieren Fallon must wait until Saturday morning to discover if he can mount Recital in Saturday's Derby at Epsom.

The High Court refused to grant an injunction preventing him from taking part, but an appeal has threatened that ruling.

Ibrahim Araci, owner of Native Khan, applied for a High Court injunction to prevent the jockey from riding Recital on the grounds that Fallon was in breach of contract.

Araci claimed Fallon had agreed to ride his 2000 Guineas third in the Derby, but Fallon opted to partner the Aidan O'Brien-trained Recital whom he rode to victory in the Derrinstown Stud Trial Stakes.

Fallon attended the hearing on Thursday where he stated that it was an "innocent understanding". Native Khan will be partnered by Johnny Murtagh in Saturday's Classic.

Mr Justice MacDuff said he was not prepared to grant the injunction sought - but gave the owners permission to appeal against his decision, which they subsequently did.
