Ulster's Dan Tuohy will not be cited for the tackle that hospitalised Toby Flood.

Flood was stretchered off the field following a forearm smash from Tuohy in the first-half of Leicester's pre-season game against Ulster on Saturday. Flood spent the night in hospital and will miss the Tigers' Aviva Premiership opener against Worcester on Sunday.

Tuohy was sin-binned at the time but the Rugby Football Union has revealed they cannot take any further action against the lock due to a disciplinary loophole arising out of the game's pre-season status.

"Ulster players were not subject to the RFU's jurisdiction in this match and as a result no action can be taken," an RFU spokesperson said. "Clubs can agree how discipline should be dealt with in advance of such games and we're looking to see how we can make sure this always happens in the future."
