Pacquiao-Mayweather threatened by fresh development

Manny Pacquiao has asked a judge to declare him the winner in his ongoing defamation lawsuit against Floyd Mayweather Jnr.

Mayweather has failed to appear on any of the 24 dates scheduled for deposition, citing a need to focus on his September bout against WBC welterweight king Victor Ortiz - his first fight in over a year.

Pacquiao is accusing Mayweather of defamation after the American suggested his rival has used performance-enhancing substances. The duo, regarded as the two best boxers on the planet, opened negotiations last year over a fight, only to see talks collapse over the timing of blood-testing before the bout.

Recently there have been suggestions that Pacquiao is willing to agree to Mayweather's sampling demands, but the Filipino's motion for default and dismissal looks to have thrown a spanner in the works.

The 15-page document produced by Pacquiao's team includes several photographs which appear to show Mayweather at parties in Atlanta and Las Vegas at the time during which he refused to be deposed.

Pacquiao is scheduled to face Juan Manuel Marquez on November 11 in Las Vegas, his third fight against the celebrated Mexican.

Mayweather is now likely to be steered in the direction of a clash with Amir Khan, the IBF and WBA light-welterweight champion, in the later stages of 2012.
